Labour market issues from a legal perspective arising in professional rugby union and professional football

Brian is a partner in the Sports Group and the Employment and Pensions Department at Charles Russell LLP, one of Britain ‘s leading law firms specializing in sports law. In this seminar Brian will discuss the key challenges presented when drafting employment contracts for professional sports players and how to address them, with a particular focus on rugby union and football players. Key issues that will be covered are: contractual concerns from negotiation through to grounds for termination and compensation; the transfer market and restraint of trade; long notice periods and “garden leave”. He will also make some reference to the experience of various forms of collective salary control systems in Rugby Super League (rugby league) and in the Football League (football) and the related implications for individual player contracts.

Brian has advised Premiership Rugby Union players and Directors of Rugby on contractual matters. He has also been involved in advising Premiership Rugby Union clubs on structures, contracts and policies. Furthermore, he has advised sports agents on contractual and immigration matters personally and on behalf of their clients incorporating FA Premier League agents (including Wright Wright Wright Limited) on transfer related issues. Brian has also advised BAR Honda F1 Team, Anschutz Sports Holdings Limited and is currently advising Eton/Dorney Lake in relation to the London 2012 Olympics.
